We provide you with a service accessible either from the web domain www.meetlapha.it or directly from the 'ALPHA' App.ALPHA is a 'connected clienteling' suite designed to provide you with a new kind of tailor-made shopping experience. ALPHA allows you to create your own always-up-to-date style profile and interact with your Brand or Store brand for tailored style requests and suggestions. With advanced functionalities, ALPHA helps you connect and have direct and facilitated contact with your 'Sale Associates'.

By using ALPHA in both desktop and mobile mode, you state that you are aware of and fully accept these general terms and conditions of use and our Privacy Policy.
If you do not accept them, we suggest not to proceed with the registration of your account. The following terms and conditions of use ("General Terms and Conditions of Use" or "GTU"), together with the "Privacy Policy", regulate this in app service.

For the purposes and effects of these General Terms and Conditions of Use, the following definitions shall apply:- "App" is the "ALPHA" application as better defined below, which under license, also in white label version, shall have the name and logo of each individual Brand.- "ALPHA" is a "connected clienteling" suite exclusively owned by MEETALPHA INC and MEEETAPLHA SRL (licensed on a non-exclusive basis as "SaaS" Software-as-a-Service is a licensing and distribution model used to deliver software applications over the Internet - i.e., as a service) for a new type of customized shopping experience.  ALPHA offers a constantly updated style profile, customized style requests and suggestions. With advanced functionalities, ALPHA helps to connect you with your Brand/Brand Store by facilitating direct contact with 'Sale Associates'.- "Information" is information about all the Brand/Brand Store products you will find in the app (Sale Associates' contact information, product sheets, collections, prices, discounts/promotional offers, events, etc.).- "Content" is all the information that you as a Registered User "voluntarily" upload into the app and that may concern you (e.g., contact details, purchase preferences, sizes, personal photos of you or your clothing).- "Registered Customer/User" is the natural person who accesses the service, registers, and creates a personal account to get in touch with the Brand/Brand Store of reference.- "Brand/Brand Store (also multi-brand)" is the legal entity of reference, i.e., the licensee of the clienteling application.- "Sale Associates" means the store contact for the Brand with which the User/Customer has entered into contact to be facilitated in their purchases.- "Registration" is the registration of a user on the website/app by which he/she provides personal data and other information required by the system.


Please carefully read these General Terms and Conditions of Use before using our app service and voluntarily giving us your personal data. LICENCE FOR ACCESS TO THE SERVICES 
All rights not expressly conferred by these General Terms of Use, or the Terms of Service remain with MEETALPHA INC and MEETAPLHA SRL or its licensors.ALPHA is a SaaS application licensed to third parties. MEETALPHA SRL and MEETPALPHA INC are IT Service Providers.We therefore invite you to also carefully read the Policies of the Brand with which you come into contact because we will not be liable in any way for the relations related to the purchase of the products.
You may not reproduce, duplicate, copy, sell, resell, visit or in any other way use for any commercial use the Services offered in whole or in part without express written consent. You may not frame or use framing techniques to misappropriate any trademark, logo, or other proprietary information (including images, text, page settings, or format) without express written consent from you. You may not use any meta tags or any other "hidden text" using the "ALPHA" name or logo without ALPHA's express written consent.The user may only use the services provided to him within the limits of the law. Any violation of these General Terms and Conditions of Use may result in the revocation of the authorization to use the App.

Use of the application is permitted only to those who have registered on the site/app and are obliged to comply with these conditions and all the policies contained in the registration screens.Registration involves the entry of certain personal data of the user, including but not limited to- First name, last name- E-mail address - Telephone numberThis data is required to set up the account, the remaining data you upload in addition may be useful to create a customer experience tailored to your needs.In order to complete the registration process and access the Services offered, you are required to accept and subscribe to these GTUs and our Privacy Policy, as well as to provide specific and appropriate consents to the processing of personal data, where required. For the purpose of the correct creation of the aforementioned registration account, as well as to allow the correct use of the app, the user assumes the obligation to provide his/her personal data complete, correct, and truthful and to keep them updated.

To create your Personal Account, you must proceed and successfully complete the authentication process.Our app provides two-factor authentication (2FA) to ensure a high degree of security.Two forms of verification are required to create the account and access the service.The registered user has, in any case, the option of deleting his profile at any time.
In this case your data will be stored by the app and by us, as IT provider, according to the principle of minimization and only for as long as is necessary and mandatory for legal purposes.Data in the database (connections, master data, preferences) are encrypted 'at rest' and only visible after authentication by the persons in charge according to the GDPR.

If registered users upload personal photos of themselves on the application (in their personal wardrobe or in private chat in the app), they accept that such personal data will be processed for the purposes set out in the Privacy Policy, as they are no longer the exclusive owner of all content entered.It is therefore forbidden to.- upload content that is illegal and contrary to national and international laws.- use content protected by intellectual/industrial property rights.The user undertakes to use the platform with good faith and diligence.The user accepts and agrees not to use the Services offered by the platform in such a way as to cause, or be likely to cause, interruptions, damage or malfunctions to the Services and their functionalities, or for fraudulent purposes, or in any case to commit unlawful activities, or to cause disturbance, prejudice, or apprehension.

Using the private chat in the ap
The User, by using the direct/private chat in app with a Sale Associate, is obliged to respect honor and decency and not to use expressions that are disparaging, defamatory or illicit in any respect, since the interlocutor and the Brand may, in the event, take legal action and refer the matter to the competent Judicial Authority, just as in a non-digital environment.Please note that:the data entered in chat by customers (profile, wardrobe, likes, requests, etc.) are encrypted "at rest" and visible only upon authentication by the designated personnel according to the GDPR.images are not saved in chat but only the URL to the encrypted image is saved It should be noted that "at rest" or "not yet (or no longer) in use or in motion" are all those data stored on any local or remote storage drives, to backups made on our local storage drives or network servers in the cloud that are encrypted by us in order to protect the security of your data.
The Customer/Registered User acknowledges and accepts that the technical characteristics and/or functionality of the system may be modified.

We assume no LIABILITY regarding the content of the data and any information entered by the Customer/User registered in the app.We do not carry out any surveillance of the contents in the app, however, if we become aware of any unlawful activities or information committed or entered by the user in the app, we will inform the competent authorities without delay.In particular, pursuant to Article 17 of Legislative Decree 70/2003, if the judicial authorities so request, we will provide them with all the information necessary to identify the user in order to identify or prevent unlawful activities.In any event, we shall not be held liable for damages, of any kind, that the Client/Registered User or third parties may suffer as a result of the incorrect use of the app by themselves or by the Brand.
To the fullest extent permitted by applicable law, in no event shall we (or our subsidiaries, affiliates, partners, suppliers and employees) be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including, without limitation, damages for use, data or other intangible losses, arising out of or relating to the use or inability to use the Service; and any damage, loss or injury resulting from hacking, tampering or other unauthorized access to or use of the Service or your user account or information contained therein; any errors, mistakes or inaccuracies in the content; property damage of any kind arising from your access to or use of the Service; any unauthorized access to or use of the Owner's secure servers and/or any personal information stored therein; any interruption or cessation of transmission to or from the Service; any bugs, viruses or the like that may be transmitted to or through the Service; any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available through the Service; and/or the defamatory, offensive or illegal conduct of any User or third party. In no event shall the Owner, and its subsidiaries, affiliates, partners, suppliers, and employees be liable for any claims, proceedings, liabilities, obligations, damages, losses.
This limitation of liability section applies to the fullest extent permitted by law in the applicable jurisdiction, regardless of whether the alleged liability is based in contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damages.Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. The Terms give the User specific legal rights, and the User may also have other rights which vary from jurisdiction to jurisdiction. The exclusions, limitations, and limitations of LIABILITY in the terms shall not apply to the extent prohibited by applicable law.

MEETALPHA INC and MEETALPHA SRL are the sole owners of APLHA (App and desktop version).The App, the software and the content of the website are protected by industrial and intellectual property laws. Users undertake to respect and not to infringe copyright and other intellectual or industrial property rights relating to the system, software.All trademarks - whether nominal or figurative - and all other trademarks, trade names, service marks, word marks, illustrations, images, or logos appearing in connection with this Website/app are and remain the exclusive property of the Proprietors or their licensors and are subject to the protection afforded by the applicable laws or international treaties relating to intellectual property.

We reserve the right to suspend and/or cancel your account, block access to the Site or the App, in whole and/or in part, temporarily and/or permanently, in the event of a breach by you of even one of the obligations set out in these Terms and Conditions and the Privacy Policy.

If any provision of these Terms and Conditions is held or becomes invalid or unenforceable under applicable law, the invalidity or unenforceability of that provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

US users
Any invalid or inapplicable provision shall be construed, interpreted, and reformed to the extent reasonably necessary to make it valid, enforceable, and consistent with its original intent. These Terms and Conditions constitute the entire agreement between the Users and the Owner with respect to the subject matter hereof and supersede all other communications, including, without limitation, all prior agreements, between the parties with respect to such subject matter. These Terms shall be enforced to the fullest extent permitted by law.

EU users
If any provision of these Terms is or is held to be void, invalid or unenforceable, the parties will use their best endeavors to agree amicably on valid and enforceable provisions, thereby replacing the void, invalid or unenforceable provisions.In the event of failure to agree, the void, invalid or unenforceable provisions shall be replaced by the applicable statutory provisions, if so permitted or stipulated by the applicable law.However, notwithstanding the foregoing, if the User qualifies as a European Consumer and is ordinarily resident in a country where the law provides for higher standards of consumer protection, such higher standards shall prevail.

These General Terms and Conditions of Use are governed by and shall be construed in accordance with Italian law.The language in which the Contract is concluded is Italian. In the event of a conflict between any versions of the General Terms and Conditions prepared in a language other than Italian and accepted by the third party, the meaning and interpretation of the General Terms and Conditions in Italian shall prevail in any case.

Personal data is processed in accordance with the relevant legislation in force. Please refer to the relevant Privacy Policy for details on how personal data is processed.

The Provider reserves the right to change the APP, these GTU and the Privacy Policy at any time to offer new products or services, or to comply with legal or regulatory requirements. You will be subject to the policies and terms of the GTU in force from time to time, unless any changes to such terms are required by applicable law or competent authorities (in which case, they will also apply to orders previously placed).

Should any provision of these GTU be considered invalid, void or for any reason unenforceable, such condition shall not affect the validity and enforceability of the other provisions.

In case of a violation of these General Terms and Conditions of Use by the user, the non-exercise by MEETALPHA INC and MEETLAPHA SRL of the right to take legal action against the third party does not constitute a waiver of the lender's right to take legal action for the violation of the user's obligations.
